>> hello, everybody. i'm denise koch. >> and i'm vic carter. here's what people are talking about tonight. >> jury selection continues right now, in the trial of julius henson. a former top aid to governor bob ehrlich. prosecutors say he tried to suppress the vote. derek valcourt has more on this case. derek? >> reporter: prosecutors say this was more than just political dirty tricks. they say it was illegal. but the defense says the content of those robocalls should be protected by the first amendment. >> we call -- we made the call. >> reporter: julius henson now admits he wrote the now infamous robocall that went out to predominantly back prince george's county and city. the call hinted it came from democrats, suggesting, we are okay. >> we're okay. relax. >> reporter: the call never mentioned it was coming from

the office of bob ehrlich. state law say its has to. the prosecutor has already scored a conviction against ehrlich's campaign manager. but henson's attorney says the case is not about voter suppression but politics. >> is a case involving who won the election, and who wants power. >> reporter: democratic governor martin o'malley had hopes to convince the jurors that henson is being unfairly targeted by those in political power. >> my client certainly thinks that. >> reporter: the state prosecutor says the decision to charge jewel rus henson was-- julius henson was not political. >> every case comes along, we try to make an individual decision of whether it merits prosecution. >> henson must convince the jury, the calls were not intended to suppress voter turnout. and. and that trial is expected to move full speed ahead tomorrow, with opening statements and witness

testimony. we're live in the courthouse, derec valcourt, -- derek valcourt, wjz eyewitness news. >> they have promised to appeal their first amendment arguments. howard county man, arrested for killing his first wife, who vanished nearly two decades ago. now, robert jared has a personal problem to deal with as well. mary is live in the newsroom with the latest on this case. >> reporter: jared's second wife, martha filed the report. this comes days after christine jared was there. christine vanished in january of 1991. her husband said she left the home after an argument. police long suspected robert jared was responsible but only recently got permission from martha jared, a second wife, to search the property where they found the body. in her divorce filing, martha accused her husband of being verbally and mentally abusive, as well as an adulterer. >> in december, robert jared

moved in with another woman in calvert county. a repeat drunk driver who ran down and killed a teenager is back in court. but this time, he's accused of getting drunk while on probation. >> reporter: for the second time, the victim's family left the courtroom, disappointed. they believe something is wrong with the justice system. >> this is prom season, you know? this is my daughter's senior year. >> reporter: instead of taking out dresses with katie, her mother, linda bosler, spent the day in in a carroll county courtroom, trying to get her daughter's killer, kevin smith, behind bars. >> i just want him to say, yes, i did this. and it was horrible. i destroyed people's lives. >> reporter: three years ago, katie was driving near friends when smith, who was drunk, ran off the road. he was sentenced to 10 years in jail, with all but 18 months suspended. with good behavior, smith

served less than a year, then he was released on probation. katie's stepfather was outraged. >> i think, actually, in my heart, it's a slap on the wrist. and it's an insult. >> reporter: as he feared, smith is now in trouble for drinking again. >> reporter: a bartender testified that she cut off kevin smith, after he got drunk at lunch, having five drinks and barely eating and food. >> i thank her from the bottom of my heart. because she stepped up and said what was going on was wrong. and she wanted to get involved and help. >> reporter: in court, a judge could have revoked probation. instead, smith was sent back for more than a year. >> reporter: what do you think of state laws that make up for this. >> i think the lack of accountability in the state of maryland is a joke. >> i don't think justice could ever be served in this case. >> reporter: as of tonight, right now, smith is back in jail. he is locked up. but if he earns enough behavior credits, he could be released before the end of the year.

reporting live, adam may, wjz eyewitness news. >> and while on probation, smith also failed to complete a treatment program. we want to update breaking news we told you about earlier today. carjacking suspects are arrested, trying to get away from police. sky eye chopper 13 over frederick road, near the city- county line. police say two men carjacked as many men at gunpoint in baltimore. they were arrested after a short pursuit. right now, police are looking for the gun used in the crime. a rare murder of a tourist stunned the nation's capital. police believe it was part of a series of attacks. and now, one of the victims is speaking out. wjz is live. mike hellgren has the story. >> reporter: after the initial contact with the suspect, the victim says he couldn't imagine he would be attacked. washington, d.c.'s mayor has said the suspect is likely mentally ill. >> reporter: the random attacks terrorized the petworth neighborhood in the nation's capital. five people were beaten with a hammer. one, a tourist, died from his injuries. his skull is crushed. now, a survivor who does not

want to be identified, is speaking about the ordeal. >> he walked on my side. with a smile and said, how are you doing, sir? before i could even turn, i was hit with something, some type of object. he hit me around my ear. and also, my lip. >> reporter: police arrested michael davis for the crimes. >> touchdown want. >> reporter: he is the brother of former university of maryland brother vernon davis, who is close to his loved ones in d.c. >> you have family that just wants to come see you and chill with you and things like that. >> reporter: vernon is now a tight end for the 49ers. his are the brother, vaunty is a defensive back for the dolphins. davis's father had a strong reaction after the bail review. >> my son is innocent. my heart goes out to the family. i know my sean didn't do it. >> reporter: vernon davis attended the white house correspondence dinner over the weekend and earlier tweeted, just got a disturbing call from washington, d.c. a good day gone bad. hopefully he wasn't involved. he once said his younger

brother michael was as talented as he was in football and hoped he could join him in the nfl. >> those are good kids over there. good kids, raised by a good grandmother. i can't make anything of it, because i don't believe it. >> reporter: now, michael davis faces the ret -- rest of his life behind bars if convicted in these attacks. and nothing was taken from these victims. reporting live, mike hellgren, wjz eyewitness news. >> idavis has another court appearance on may 11th. the woman in charge of maryland's transportation system is slepping -- stepping down. beverly wayne staley is leaving her post, july 1st. she is the first woman to head the state's transportation department, appointed by governor o'malley in 2009. well, higher taxes and cuts. that is the heart of the fight over where there should be suggestions. pat warren says there is a lot riding on what happens next.

>> that's right. but there are those who aren't necessarily in favor of a special session, as much as there are those in favor of it. a special session is going to mean an income tax increase. >> for or against the special session, it's all about the spending. how much will be spent for k through 12 education. how much they should spend for higher education. how much should be sent to keep state agencies funded. >> so many people who are poor, who are powerless, are subject to the whims of these three elected leaders. >> reporter: those leaders, the governor, senate, president and house speaker, are also be taking heat from those who don't want a special session. >> it's becoming almost unaffordable to live in the state of maryland. >> reporter: the maryland chapter has -- something posted on its website. today, a coalition in favor of a special session held a news conference, urging the governor to bring lawmakers back. >> get it back together.

get it resolved and do it quickly. >> reporter: that is expected to include an income tax increase, to include $512 million in cuts. thousands of marylanders are signing their online petitions against it. >> and people are going in and signing that petition. telling governor o'malley, we can't afford another billion dollars in spending. and a special session is not the answer to get maryland's economy moving. >> reporter: well, governor o'malley has said he will not order a special session until he's sure there's a consensus so they can get in there and get the business taken care of this time that they were not able to get done during the session. reporting live, i'm pat warren. back to you on tv hill. >> all right. thank you, pat. the budget takes effect july 1st. the sun is finally peeking out after a cloudy day. live look outside now. cooler temperatures as well. any rain moving this way? wjz is live with first warning weather coverage. meteorologist bernadette woods and bob turk are keeping a close eye on live doppler radar.

bob? >> side night's rain was really not much to speak of, unfortunately. most places fell less than a tength of an inch. there's more rain possible, late, late tonight. take a look at radar. out to the west, a bunch of showers and thundershower activity across indiana. down into kentucky as you see. it's moving off to the east. maybe after nid -- midnight or 1:00 or 2:00 in the morning. we might see some shower activity, which might linger. we're r right now, we're at 62. 70 in cumberland. 68 in oakland. but out across portions of ohio valley now. temps in the low 80s. and that warmer air is going to be moving our way tomorrow, after the rain. it might be an afternoon pop-up shower for the most part. we're just going to get a lot warmer the next few days. bernadette has a look at some of those temperatures headed our way. >> that's right. bob was just talking about it. the warmup is moving our way. tomorrow is just part 1 of that warmup. look at temperatures around the country. already getting into the 70s. and as bob said, low 80s in

it is partly cloudy. 62 degrees in central maryland right now. the complete first warning forecast is coming up. it is now official. the new hospital building at johns hopkins is up and running. wjz is live now. jessica kartalija explains how the transition to the new building is going. jessica? >> well, as you can imagine, moving all of the patients out of one building and into another, virk, is quite a process. >> reporter: amanda gonzalez has been a mom for just three hours when nurses at johns hopkins hospital tell her it's time to go. after the official grand opening of the new 560-bed facility, patients like amanda must be moved from the older rooms to the brand new building. >> finally done, years of planning in the making. and so much training. and everyone said it went so well today. >> reporter: in labor and delivery, the nurses had over 20 hours of training. just to make this move possible.

>> it was very choreographed. >> reporter: amanda and her new son cruise are among the first patients in the maternity ward, where there are three operating rooms, 35 obstetric room, and 10 private labor and delivery rooms. >> reporter: all of the rooms here in the new building look a lot more like a hotel room than a hospital. they're all private, they have state of the art television networking. they have hardwood floors. not a bad place to be when you just had a baby. >> it's gorgeous. you know, we actually tried to wait until 9:00, so that we could be the first baby delivered in this ward. and we got to be the last one delivered in the old wing. and then the first ones in our new room here. so we got the best of both worlds. >> reporter: hospital admin administrators say the facility now matches the science of johns hopkins, a hospital of the future for the next generation. >> reporter: and hopkins administrators tell us that the whole hospital is very patient-

centered. so patients who are here for an extended period of time, the rooms are large enough where their families are encouraged to come and spend time here at the hospital with those patients. live at johns hopkins hospital, back to you guys on tv hill. >> pretty place, jessica. thank you so much. the hospital was funded largely through private donations. last summer's earthquake, damaged buildings up and down the east coast, including one well-known building here in baltimore. >> one of the most historic is about to be repaired. and the baltimore basilica should be used to scaffolding by now. >> reporter: six years ago, baltimore's basilica, circa 1806, underwent a massive historical restoration. the changes were supposed to last a lifetime. but whether you call it an act of god, or mother nature, the east coast earthquake left its mark here. >> you can see the cracks there. >> one look up, and you can see dozens of cracks visible throughout the basilica. none of it is serious

structural damage. so the archdiocese was able to wait until now to begin repairs. >> we've seen the cracks now starting to expand. and just for health and safety reasons and all. to help the maintenance, we thought the time was right to start to address that. >> reporter: the repairs will cost between $3 and $5 million, but the basilica had earthquake insurance to cover the costs. >> during the renovation, daily will shift down here to the undercroft, a space many people have never seen. >> reporter: also impacted, the popular tours of the basilica. they will be limited during the renovation. each year, more than 100,000 will visit. >> it's beautiful, so bright and airy. >> reporter: diocese hopes the repairs will be completed by ash wednesday in february of next year. denise? >> all right. thank you, mary. the earthquake also damaged

wind, up to 10 to 13 miles an hour. should be quite light later on. to the west of us, shower and thunderstorms today. with some moisture coming out of the gulf of mexico. very warm temperatures, kentucky, west virginia, all of this area, tennessee valley. temps in the low to mid-80s. and that is moving in our general direction. should be here tomorrow, around 80. maybe close to 80 on wednesday. and even warmer, we think, as high pressure builds to the south. we are going to get pretty warm air. southern florida, getting some rain. little tropical system. not named or anything. but there's circulation. south florida could get two to three inches of rain. and they need it. to the west of us, showers and thundershowers. over the ohio valley. there you see them. moving off to the east. so late tonight, maybe after 2 -- 2:00, 3:00 in the morning. you see shower and thundershower activity. once the showers leave, wednesday, probably in the low to mid-80s, there's a slight risk of a shower or thundershower, wednesday afternoon, maybe even thursday

just seconds before 6:30. 62 degrees and mostly cloudy. good evening. thanks for staying with wjz. here are some of the stories people are talking about tonight. the tallest building in new york is once again in lower manhattan. one world trade center surpassed the empire state building today, marked by a special ceremony. manuel gallegus is there for wjz with more. >> the recovery and in lower manhattan reached new heights with the placement of this steel beam. it now stands at 1271 feet high. 21 feet taller than the empire state building. >> it's inspirational.

and it is going to make a lot of people happy. jazz it took a while after september 11th, for construction to get started. but eventually, at a rate of a new floor every week, the tower started to alter manhattan's skyline. locals and tourists marveled at the structure. the milestone comes close to the one-year anniversary of the death of osama bin laden. >> you're not going to stop america. we're going to rebuild and keep going. >> sends chills up and down your spine when you think about what happened. >> reporter: from here on the 71st floor of the building, you get a real sense of just how massive this structure is, and how tall it is. take a look at this panoramic view of all of new york. >> reporter: something what is noticeably noticeably different from all of the twin towers is that the buildings are all glass. windows, floor to ceiling, all the way around. the tower is one of several buildings under construction at this site, which is also home to the national september 11th, memorial and museum. >> it's been an act of passion and an act of patriotic duty. >> reporter: the skyscraper

isn't expected to reach its full height for at least another year, when the needle is added. the tower will top out at 1776 feet, making it the tallest building in the united states. in new york, manuel gallegus, wjz eyewitness news. >> now, the tallest building in the world, is the verge khalifa in dubai, -- tragedy at the bronx zoo. the investigation continues into the deadly accident that killed three generations of one family. mary is live in the newsroom with some of the just-released information. >> reporter: the suv plunged more than 50 feet off the overpass. take a look. you can see the mangled honda pilot. seven people died, include three children. investigators say the mother of those children was behind the wheel. her sister and parents were also killed. a short time ago, police say the suv was going above the speed limit but was likely just keeping pace with traffic. the driver clipped the highway

divider, damaging the tire. that likely contributed to the suv losing control and going into the ravine. the investigation continues, but police don't expect any crim. vic? -- criminal. vic? >> mary, the accident is the second in the past year, where the car tum tumbled offer the same stretch. rooftop batteries. a controversial plan to keep the summer olympics safe. monica villa villamizar explains what may be done. >> reporter: the surface-to-air missiles on this apartment rooftop, during the summer olympics. they say the missiles are the best way to protect the skies over london during the games. residents received leaflets, notifying them that testing will begin this week. >> i still can't get it through my head, why they decided to use a residential area. >> it does raise a lot of questions. whereby they can put missiles on private property. >> reporter: police say they will be based at the sites where the missiles could be

placed. but residents worry that these locations could become targets for terrorists. >> generally, in this country, the military don't just announce that they're going to occupy private property. it puts us at risk. >> reporter: authorities insist, the missiles are not a hazard to residents and will only be used as a last resort. security experts say the plan is necessary to prevent a 9/11- style attack. >> it's all about deterrents and control of the air space. the government has an obligation to the international olympic committee to protect over 100 heads of state who are visiting and all of the athletes. >> reporter: if the defense plan goes forward, it would be the first time since world war ii that missiles are deployed in london. >> in london, monica villamizar, wjz eyewitness news. >> and more than 13,000 troops will be deployed during the summer games. an abanne arundel county -- anne arundel county homeowner is shocked to find a man inside his home. the man woke up to find 43-year- old brian white inside his

troil is set to begin tomorrow, for the man accused of stabbing as many as 19 people in three states. elias is charged with three murders and six attempted murders in flint, michigan. the 35-year-old posed as a stranded motorist to lure his victims in. he is also linked to a number

of nonfatal stabbings in virginia and ohio. still no progress in the search for a missing 4-year-old girl. -- arizona girl. 6-year-old isabel salas has been missing. surveillance tape caught six people walking near the home around the time she disappeared. police are questioning three of those people. a beach comber found this container in british columbia. and get this. it was actually carrying a harley-davidson motorcycle. the license plate on the container is registered to a japanese moving company. so far, no one has been able to find the bike's owner. it is believed the u.s. is protecting a well-known dissident in china. a deal between the two countries may be in the works. but the case could strain relations. just days before secretary of state hillary clinton is scheduled to visit. danielle noting reports from
